The photos in the Bettman are presumptively protected by copyright, but I don't think it's an easy analysis. My understanding is that in many cases original prints were placed in the archive without any care as to reproduction rights. I also understand that a few photographers were surprised to find their photographs in the Bettman once the images were put on-line. Corbis licenses the use of the images; no doubt the rationale is that they are licensing their copyright in a digital file, even if the underlying image is now public domain.
I guess my main point is, don't assume that what Corbis claims about rights is true as to all images.
