10:00 - 11:30 CASE LAW
"Recent Decisions and the Implications for Database Publishing"
By Eric Schwartz, Partner, Smith & Metalitz

Mr. Schwartz will discuss the most recent case law including cases resulting from the Digital Millennium Copyright Act.

11:45 - 1:00 LEGISLATION
"The Digital Millennium Copyright Act: What Does It Mean?"
Marybeth Peters, Registrar of Copyrights, Library of Congress

Ms. Peters will report on the status of Distance Education recommendations currently being considered as an extension to the Digital Millennium Copyright Act. She will also discuss what the Copyright Office is doing with regard to allowable circumvention of technological protection of data.

"Update on Database Protection Legislation"
Bonnie Lawlor, President, Chescot Publishing, and Chair, NFAIS Information Policy Committee

Ms. Lawlor will provide an update on the status of legislation relating to the protection of databases. At present it is believed that new bills will soon be introduced.

 2:00 - 4:00 STATE LAW:
"The Uniform Computer Information Transactions Act (UCITA): What It
Is and How It Impacts License Agreements" Sarah Wiant, Director of Law Library, Washington & Lee University

Prof. Wiant will give a history of UCITA, its current status, and cover a few essential points which are causing angst to the library/user community (things that may end up being deleted by states, things that producers need to know when writing licenses, etc.)

"UCITA and the Shrinkwrap/Clickwrap License"
David Mirchin, Vice President & General Counsel, SilverPlatter Information, Inc.

Mr. Mirchin will focus on the aspect of shrink-wrap/click-wrap licenses with regard to UCITA. He and Ms. Wiant will then discuss the issues that have been raised in what promises to be a lively discussion.
