David's post is quite timely, for the Supremes have agreed to hear a case involving trade dress protection for product configuration. They granted certoriari to a Second Circuit decision involving trade dress protection for clothing designs with a particular type of collar and appliques, if I'm remembering correctly. At issue is the appropriate test for establishing "inherent distinctiveness" of a product configuration. As I recall, there are a bevy of amicus briefs on file.

Apologies for being off-topic, but does anyone know the status of the case?
