There are lots of songs which are sampled with licenses, where the old version is still in print and the derivative work isn't the subject of an injunction. For example, Dario G's "Sunchyne" samples The Dream Academy's "Life in a Northern Town." Sample clearance is a big business; not all samples are litigated.
