DMCA and online course materials

Dear List Members,

Am I right in reading the DMCA to say that it essentially doesn't offer "nonprofit educational institutions" any protections with regards to online course materials prepared by faculty?

This is from my reading the new Copyright Act sec. 512(e) [from Title II, Sec. 202 of PL 105-304] "Limitation on Liability of Nonprofit Educational Institutions".

Would others concur with that interpretation or am I just misreading it? If so, it limits the appeal of following the requirements of the DMCA as this would be one of the big areas in which copyright problems might arise that the institution might hope to have some protection from.
