You might want to have a look at http://www.negativland.com/ -- the site for the band negativland, who sampled some U2 music, were sued, and lost. They've got some excellent resources on that site; I've used their book -- "Fair Use: The Story of the Letter U & the Numeral 2 (with CD)" -- in Technical Communication courses with good results.
