I think the publications are not being unscrupulous, just sloppy. What they are trying to say, in their poorly-drafted way, is "If you send us an article we didn't ask for, we don't have to send it back to you; we can just throw it in the trash." I don't think most of these publications are trying to steal copyrights, just get themselves off the hook for disposing of unsolicited materials.
