It appears that Microsoft is attempting to use 512 provisions of Copyright, and possibly 1201 as well, to defend a (questionable, IMO) trade secret. Questionable because the "secret" was freely distributed by MSFT, but gagged, such that recipients would be unable to publicly or privately discuss it except with Microsoft, under the terms of the clickwrap attached. A secret that everyone knows, even if they're not supposed to talk about it, is no secret.
