INFO/NYT: Napster Lawsuit Creates Copyright Clash With Important Intellectual Property Issues and Precedents at Stake

  REGARDING A NEW YORK TIMES ARTICLE WITH LINK AND EXCERPT BELOW:      The legal maneuvering between Napster and its legal opponents is escalating. Napster has hired the lawyer who lead the Federal Government's case against Microsoft while injunction is being sought against Napster operating their music downloading enabling operation while this case is being considered and decided. The case will be likely to generate very important legal precedents as the legality of enabling the sharing of copyright protected digital files by connecting the downloader to the source of those files is at stake in this case decision. This is a landmark decision case in progress for the field of copyright in the context of the internet and its use for software and file access and downloading.

     SAN FRANCISCO, June 15 -- Napster, an Internet music 
start-up, and the recording industry sharpened their legal strategies this week in a battle with potentially broad implications for copyright law in the Internet era.

     The legal maneuvering is a precursor to a July 26 hearing in federal court in San Francisco in a case that many see as a landmark for unresolved Internet and technology-era copyright issues.
