Another tricky question related to the interesting situation of the need for Copyright registration that I would like to have some opinions on is:
Clearly it is a prerequisite for claiming costs and attorneys fee that copyright owners have filed a claim for copyright prior to infringement but what if the copyright has been registered earlier but registration invalidated due to formalities and copyright restored by the URAA/TRIPS
Will the owner then be able to claim costs and attorneys fee in case infringements occurs before claim to copyright has been registered a new ???
