The distinction as I see it is that the toaster is clearly within the scope of UCC II. It is clearly a good. I would be hard pressed to see how the battle of the forms would not resolve in the consumers favor in that case.

But if the legislatures are willing to pass the UCITA, despite all of the opposition, ranging from Ralph Nader to the IEEE, then I see no way for this sort of thing to pass.
