I realize that this is kind of more back on the original question (which had to do with music sampling) but I run into similar questions all the time -- how much of XX piece of writing can I change and have it not be infringing? They think there's a percentage, usually.
I tell them to envision the Mona Lisa. Now, tell me what 10% of it is. They usually get the point.
