I believe that facts by themselves can not be copyrighted and fair use therefore applies, not definitions of derivative works or other such fine print.
I believe many Americans could care less about the fine print. Maybe that is why copyright is denigrated by younger generations. I know middle school youth that burn music CDs at home. I try to tell them about copyright: you can copy CDs you own; you can't give copies away to your friends; and other fine points. Silence...then major laughter. What a joke they say! Why do the ads say rip and burn? Why buy something if there is only a couple of good tunes and the rest is junk? The fine print does not cut it in this setting.
If all we can offer to support copyright is the four factor test of Section 107 and other such legalese, copyright may continue to exist, but a lot of people will keep on ignoring it. Received on Tue Sep 03 2002 - 16:22:40 GMT
