As I understand it the "fair use" law was not codified until the most recent revision of the copyright law in 1978. The case you mention, which I have not read, might be part of the reason for getting the fair use rules in place. By the way the number of words may be helpful information but is not the final word in copyright cases. Once a case was lost over the use of only one word. The word was supercalifragilisticexpealidocious, but it was only one word.
