Originality

Hello,

I am a law student in Canada and am working on a research paper. Specifically I am looking at a recent decision of the Federal Court of Canada and how the court defined originality in coming to their decision that some law journal publishers hold copyright to the judgments they include in their journals (not of course the judgment proper but everything that surrounds it).

I am reading the cases relied upon by the court and am particularly interested in the differing approaches to the definition of originality depending on the country in which the case is being tried. One case of course cited by the court was Feist and all the relevant commentary. I was wondering of any of you on this list had some cases or commentary to which you could to draw my attention.

Thanks in advance,
