TEACH Act - Commercially Available Digital Materials

If an educational entity publishes a printed curriculum with a CD version tucked inside, does this qualify as a "work produced or marketed PRIMARILY for performance or display . . . via digital networks" under the TEACH Act such that digitizing the work w ithout permission would still be a copyright infringement? Any thoughts appreciated.
