online video

Hello -- This is a question from a member of the faculty who wants to use 20 minutes of a 1-hour video in an online course. The company that produced the video has apparently gone out of business, so she has not been able to get permission to use the video. We are wondering if permission is necessary, since the course will be accessed only by the students who paid for the course. The course will be erased at the end of the term. She would not need permission if the video were used in an in-person course, right? So, would she need permission for the same course that is taught online? Thank you.
