San Jose Mercury News confirms it was filed Monday 12 May in U.S. District Court in New York.
Reuters says it's "joining" an existing suit but (as a journalist) I take that for journalistic approximation.
http://www.nyed.uscourts.gov/coi/cases_of_interest.html doesn't have it.
http://www.umusic.com/static/about/2003_press.html doesn't trumpet it, oddly.
