I'm saying that the W3C standards for the world wide web are properly and reasonably treated as "usage of trade" definitions under the UCC. As such, they guide courts in their fact-finding attempt to give meaning to the terms within an HTTP transaction, which according to those spec is properly viewed as an explicit licence to copy and use.
