I am told the defendant raised the issue of unconstitutionality
in restoring copyright once lost to the PD and cited the Graham
v John Deere as authority. However the 5th spent little effort
on the subject as seen in fn 33. Admitted I did not read the
appellate brief yet thus relying upon verbal information.
