Are you a visual artist, an art lawyer, an agent, a dealer, an art student, or any other person who deals with works of visual art? If so, then you are invited to participate in a survey about visual artists' moral rights.
Imagine you have painted a spectacular portrait, only to have someone cut up the painting and sell the pieces. Or imagine someone takes credit for your work. Or imagine you own the building that a mural has been painted on and you want to paint over the mural. An artist may have certain rights in these circumstances which affects both artists and the people who buy art..
Thirteen years ago, Congress passed the Visual Artists Rights Act of 1990 ("VARA"). VARA gives the author of a "work of visual art" the rights of attribution (right to claim or disclaim authorship) and integrity (right to prevent mutilation or distortion of work). These are sometimes referred to as "moral rights." The purpose of this survey is to measure awareness about VARA, to gauge VARA's impact on visual artists, and to determine the impact of waiver provisions on visual artists covered by VARA. The results of this survey may be published in a law journal.
