Although the holding in Tasini may have been narrow, it's effects on the publishing industry are not limited to the holding itself. As a consequence of that ruling, many publishers have taken a hard look at their agreements with authors and made an express effort to close off any "loopholes" that might let authors retain control over their works in unanticipated ways.
