I agree with your reasoning on this, although I wonder
if they would be successful in arguing "fair use." I
don't think it would be a clear cut case, but it may
work. I guess the fact that it is not a clear cut case
is good for a deep pocket like Amazon.
Have you researched whether they will let you pull a work from the searchable database?
