UCC section 2-312(b)(3) states that "unless otherwise agreed a seller who is a merchant regularly dealing in goods of the kind warrants that the goods shall be delivered free of the rightful claim of any third person by way of infringement . . ."
As a general matter, a disclaimer of any implied warranties will disclaim the warranty of non-infringement. It need not be specifically named, as does the warranty of merchantability.
This analysis assumes, of course, that a court would characterize the transaction as a sale and not a license.
