Ongoing questions re: music in low budget documentary. what if the film has some live footage of activist marchers and during the march they are singing an identifiable very commonly known song that is copyrighted. say 10 seconds. this is just what they happen to be singing. in another place in the film, people are captured on the footage singing a different identifiable song for about 2 seconds. In neither instance does the use of the music impact on the marketability of the songs. Rather than going around kicking sleeping dogs at publisher's houses asking them whether these would qualify for "fair use" I'd like to ask the folks here. I would like to tell my client its "fair use." Seems reasonable to me. its an educational political non-prof film. what thoughts? hope this isn't too sophomoric for you all. Kathleen Williamson
