Empirical observation. Rarely do you see the actual copyright owner posting to a usenet group. In fact, there's often a running commentary in the groups between posters and others threatening to "turn them in," most of which generally devolve into the kind of name-calling not often seen outside of grade school playgrounds.
Given that copyright notice is no longer required, and renewal is no longer required, the vast majority of images that are either created digitally or digitized appear to be images for which the copyright has not yet expired. Even if a copyright owner were to post an image to a usenet group, it would be stretch to say that the owner had granted a license, implied or otherwise, to use the image in another medium.
