To protect a title of a game I would look to trademark
law.
If trademark law will not give you the protection you
seek, it is likely because the protection you seek is
broader than the law allows.
Sometimes, vague questions lead to vague answers. If
you can explain why you are avoiding trademark
protection we may be able to point you in the right
direction. If you can describe your fear in concrete
terms, it may be that other causes of action will be
at your disposal.
