I don't know what the government's view on this is (I look forward to
hearing what Mike discovers about that) but the Regulations could not deal
with performers' moral rights because the directive is silent about them -
or, rather, it expressly leaves them to national laws. The Regs were made
under the European Communities Act and that only delegates powers to
legislate to meet a Community obligation. Perhaps the real question is, why
didn't the European Commission write performers' moral rights into the
directive?
The Commission did some work on moral rights years ago, and maybe they came to the conclusion that there was no reason for promulgating a directive which would have to be on the basis of an effect on trade between Member States.
