And you can also provide that if the work doesn't qualify as a work for hire, the parties unequivocally assign all of their rights in the work to you. Not quite as good as a "work made for hire," but it gets you most of the way there.

You can always agree that the "effective date" of an agreement is some time before the agreement was signed. It's a part of your agreement.
