The first question on pre-dating is whether the work itself is of course, subject to w-f-h doctrine. The next question is where are you/them located.

If you are in the 7th circuit, the predating will not work. See, for instance, Billy -bob, 329 f3d. 586

If you are in the Second Circuit, it's a different story, per the Playboy line of cases.
