IANAL, but ISTR that appeals courts EXIST to resolve disputes on what the law IS. Questions of fact are not decided there. (with certain exceptions, like territorial disputes between states , where the first stop IS the Supremes etc) I'm not generally in favor of legislation by the Judiciary, but if the legislature could write more clearly.....
