How is that different from a bunch of '1's and '0's in a digital file? The computer, printer and monitor work together to interpret those instructions.
I think the digital 'photo' stored on a memory device is more clearly a 'set of instructions' than the latent image on the film.
If the instructions on the film are not protected, then the instructions in a digital file should not be protected. I don't think that is the state of the law.
By the way, I think the paint by numbers people may disagree with you regarding the copyright in their products.
