The Alumnae Association at my institution sponsors trips for alumnae. They could be considered quasi-educational, as they are led by current faculty members. The Alumnae Association wishes to use a portion of the painting "View of Mexico City" by Pedro Gualdi on the cover of a brochure for a trip. "View of Mexico City" was painted in 1842. The brochure would go to approximately 18,000 alumnae.
I would assume that this painting is in the public domain, but does the fact that it is not American have an effect on this analysis? Could a Fair Use argument be made here? What other copyright issues do I need to be aware of?
Thanks for any advice. I'm relatively new to this copyright stuff and am even less adept at images than I am at print.
