There was a UK case that involved silence. The publishers of John Cage's silent composition 4'33" accused Mike Batt, the man behind the Wombles, of plagiarism and copyright violation for a track called "A Minute's Silence" on his "Classical Graffiti" album. Although he argued that his silence was original, not a quotation from Cage's silence, the case settled out of court with the payment of a sum to the John Cage Trust.
