In my memory I do not think that it is correct to call recorded silence. The
point of Cage's piece was to have the audience focus on the nature of a
performance by being aware of its absence. So what was recorded was the
small still sounds of an audience in contemplation. We may call such absence
of a musical performance "silence", but there were sounds recorded.

I used this as the basis for a question on my final exam a couple of years ago. About half the class totally missed the issue of whether recorded silence is subject to copyright.
