When I worked in an x-ray department, when God was four, it was not the radiologist who took they x-rays. That was done by the x-ray techs. The radiologists only reads the x-rays and dictates a report for the physicians. If we are equating anyone to a photographer, should not it be the x-ray tech?

All said and done about the WORK FOR HIRE and hospitals retaining the copyright, is it ethical for the doctor to use a patients records for research or commercial purpose...is it not exploiting?

My cats' vets claim "property" rights in their x-rays, with notices warning you against reproduction, without using the C-word. They may be relying on the files adding value to the practice if they sell, or perhaps to use as teaching or research materials down the road.
