An archives is an agency and/or building that acquires, preserves, organizes, and provides public access to the non-current records (in any format) of an instutution or individual. For copyright pusposes, I believe it is important that the archives makes the records accessible to the public. An example of the reformatting provision is the transfer from 16 mm film to VHS or DVD that I do in order to facilitate access to the records (ie. the information preserved on the film).

This may seem a silly question, but what is considered an “Archive”? Section 108 of the Copyright Act provides exemptions to both Libraries and Archives for the reproduction of damaged, stolen or deteriorating works, or works whose format has become obsolete.
What constitutes an Archive?
