Frenchies striking again ? The suit from AFP is not linked
to the Irak invasion, it is more linked to the difference
between continental europ copyrights tradition between the
US and Europe, a fight against "free" use of AFP contents by
Google through websites legitimately buying AFP contents to
attract visitors and also willing to reach a high ranking in
google search results!! Internet is so powerfull and easy to
use that almost all kinds of traditional copyright
protection schemes seem to explode.
However:
AFP is right in searching copyright protection
AFP should know better and ask all his clients willing to
distribute AFP news on their websites to fulfill the
obligation to protect AFP news pages by a "No bot" tag to
prevent google (and all others) to index the news,
Verify (easy!!) that such no bot tag is present,
If Google still display the news, then AFP can sue its
client first (!?) for breach of contract; Google can be sued
by AFP's client (trespassing) separately and in conjunction
with AFP himself.
We can expect to see more on this from european companies
against google, MSN, yahoo in the near future

By the way we are looking for a patent/IP lawyer in
California willing to discuss a potential case against 2
search engines on a success fee basis. The case will be e
beautifull example of trademark trespassing, non competitive
practice, will open high controversy and will attract
immediate medias attention.
