The law says "ordinarily visible" from a public place.

This would seem to make privacy fences effective to make a photograph of the building not protected under US law.

To what extent "ordinarily visible" would require to the naked eye or would allow use of telescopic lenses or other remote sensing technology would be an interesting point.
