I'll take 6/16, 9-0 to reverse and remand, but appellants are the real losers. It's time to refine Sony, and they love to reverse the 9th Cir. The district court has to hear some evidence on the meaningfulness of the claimed substantial non-infringing uses before ruling that the potential for legitimate uses, even if currently unrealized or overwhelmed by infringing uses, cannot be foreclosed. Tie-breaker: Kennedy for the Court.
