Transcribing Public Domain Materials

Hello.

     I found a website with a substantial amount of public domain material. On the site's copyright page, the site's owner said that those files are in the public domain, that they make no claim to ownership, but the site also states that people wanting to use those files for commercial purposes must retranscribed (retype) the materials found in the file.

       How can they enforce this? Is it enforcible?
