The folks in our Continuing Education Dept. want to create a printed brochure to be distributed to the attendees of a reception launching a series of workshops that will take place over the upcoming academic year. They expect a select group at this function, perhaps 25 or 30 folks. They want to include in the brochure the images of some of the movie posters and book jackets that will be taught during the workshops. There are 4 film images and 4 book jacket images.
The images have come primarily from the web, Amazon I think, but some of them could be obtained from the publisher of the series on which the workshops will be based.
Would the use as described be considered Fair Use? The more I review the 4 components of Fair Use, the more confused I get. I am unsure about the use of the images on the brochure.
Question #2 - Would Fair Use apply if they created a brochure including the same images to be used for a mass-mailing soliciting potential enrollees. This is a question for next year, as this year's mass-mailing has already gone out without any film or bookjacket images.
Question #3 - (an aside) Does Amazon have permissions/pay royalties for the images on their site?
