Good question. Section 110(1) says, in pertinent part (assuming we're talking about a non-profit school):

   ...the following are not infringements of copyright:

   (1) performance or display of a work by instructors or pupils in the    course of face-to-face teaching activities of a nonprofit educational    institution, in a classroom or similar place devoted to instruction...

The only real question is whether, given the purpose of the performance is for entertainment or reward, such a performance qualifies as being "in the course of face-to-face teaching activities." Received on Mon Jun 27 2005 - 21:15:15 GMT
