Use of Film Poster with Celebrity Image

A filmmaker wishes to use a thirty year old film poster as a prop in one of his films. The poster advertises a "revival screening" and prominently features an image of a great silent film star. The silent film star's estate is currently represented by an intellectual property / management firm.

Question: Does the filmmaker need to seek permission to use this poster as a prop in his film? The creator of the poster is willing, but does the silent film star's image -- even if used as a prop -- cause further problems, specifically regarding rights of publicity?
