You might want to look at the Avalon Hill versus Microprose battle over Civilization to see just how protracted this could get if somebody decided that there was real money involved.

Thanks for the advice. There is no real money involved as this is a very niche game. In fact, its so niche I really wonder if the 3rd party software house has done any market research.
