  That's what I was thinking. Amazon will likely pull the book, esp. if you wave the DMCA at them. That will get the publisher's attention and you'll have the opportunity to see if he's telling the truth about US sales being insignificant. And, by the way, the publisher doesn't get to decide whether the photographer should sue ("these third party sales are insufficient to subject the publisher to suit in the US"). The photographer makes that decision.

  And I sincerely hope that the photographer registered his photo with the US Copyright Office before the infringement.
