You need to have a design code to search the design in the database. And, frankly, the USPTO site is not a good one to search. Use TRADEMARKSCAN via Lexis or some other -- probably codes for circle, face, and smile.

Registration can be based on intent to use the design as a trademark, but it must be in connection with particular goods or services. The design is submitted in jpeg format.

But, go through the USPTO site and it should answer most questions.

Good Morning,

I am looking for information on how to register an image with the US Trademark Office.  

I started by visiting their website. I tried to search for images like mine in the catagory section (to see if the drawing already exists). By the way, the image is a smiling face. I was unsuccessful.

Here is a little background information. I drew a cute image, and I decide to register it. I'm not sure what I will be using it for in the future. Someone told me to register it with the US Copyright Office and the US Trademark Office. I found the info for the US Copyright Office, but the US Trademark is a little bit more involved. I will be contacting the US Trademark Office. I thought I would ask around as well.

Any information would be greatly appreciated. Many Thanks.
