There are two problems with your response. One problem is that it will be costly for the defendants to defend themselves against the authors' claims. Second problem is that the threat of lawsuit produces chilling effect on people's freedom of speech.

You seem to assume that the judge or presiding officer of a court of law is perfect and will dispense perfect justice. That does not work in the reality.
