If Company has no rights to reproduce or distribute the design, they
can't use it as a trademark; the ITU application doesn't give them
any rights to it. It's not entirely certain, from your hypo, whether
Company does, or doesn't, have such rights; a court could imply some
sort of a non-exclusive license to use the logo from these facts,
which would let them use the design (upon suitable payment to Designer)
