Fortunately, in Canada we have a provision in our Copyright Act that was added in 1988 allowing for application to the federal Copyright Board for a licence to use a work whose copyright owner cannot be located (Section 70.7). Clear guidelines and procedures have been set out by the Board and quite a few licences have been issued for a variety of types of works and a variety of uses.
